Workers’ compensation is a form of insurance that provides indemnity  and medical benefits to employees injured in the course and scope of their employment in exchange for the mandatory relinquishment of the employee’s right to sue their employer for the tort of negligence. The trade-off between assured, limited coverage and lack of recourse outside the workers’ compensation system is known as “the compensation bargain.” The insurance plan is designed to be self-executing by the employer’s insurance carrier or servicing agent, monitored by the State of Florida Department of Financial Services Division of Workers Compensation, and judicially supervised by the State of Florida Division of  Administrative Hearings office of Judges of Compensation Claims. The insurance may be mandatory in many cases and both the employees and employers have certain responsibilities under Chapter 440 of the Florida Statutes.
